The Environmental Information (Scotland) Regulations 2004 provides you with a general right of access to recorded environment information. Subject to certain conditions and exceptions, if you make a request for recorded environmental information you will be entitled to receive it.

Environmental information includes information about air, water, soil, land, plants and animals, energy, noise, waste and emissions. It also includes information about decisions, policies or activities that could affect these aspects of the environment.

We maintain a Guide to Information (Publication Scheme) which details the information we make available routinely.

If the information you seek is not available on our website, you can make a request to access that information.

Your request does not need to be made in writing, and whilst you are not required to do so, we have created a form which will assist you to provide the information we need to process your request.

You can submit your request electronically by completing our online enquiry form. Your request should detail the information you seek or provide as much information as possible to enable us to locate the information you seek. If required, we may write to you to clarify aspects of your request.

Once we received your written request and clarification, if this is required, we will acknowledge your request within 3 working days and will respond to your request within 20 working days from receipt.  However, a 40 day response time can apply when requests are complex and voluminous.

There may be some exceptions to providing the information and if this is the case we will inform you of this, as well as reasons for applying the exception.

If you are not satisfied with the response you receive from us, you may request a review.  Details of how to do this will be provided with the response. 

If you are still dissatisfied following our review you may appeal to the Office of the Scottish Information Commissioner.  Further information about the Freedom of Information (Scotland) Act, your rights under the Act and the obligations placed on us can be found on the Office of the Scottish Information Commissioner's website.
